The Case Assessment Conference

In family law proceedings involving property and financial matters, the first major event that you will attend in Court is usually the Case Assessment Conference. The Case Assessment Conference is conducted by a Registrar (that is, a Court Lawyer). Both parties attend and they are legally represented, their Lawyers also attend. At a Case Assessment Conference directions are made for the future conduct of the proceedings.
With the assistance of the Registrar, the Case Assessment Conference also provides the parties with an opportunity to attempt to reach an agreement. If any agreement is reached, final Orders can be made resolving the matter and there will be no need for further Court attendances.
If the parties cannot reach an agreement, the Registrar will then:
- Identify and assess the main facts and issues of the case;
- Where appropriate, the Registrar may recommend that other services or steps may help to settle the dispute (for example, obtaining a valuation or exchanging certain documents or information);
- Explain to the parties what will happen next.
