Court Orders in Property Matters

Many couples, often with the assistance of their legal practitioners, are able to agree upon a property settlement and Consent Orders (a set of Orders that reflect the agreement the parties have reached) can then be drafted and filed in the Court without the need for either party to attend Court.   Consent Orders have the same legal effect as if they had been made by a Judicial Officer following a Court Hearing. Consent Orders are no different to other family law orders.

In some cases, parties cannot agree and after receiving family law advice one party will file an Application seeking that the Court determines the matter and makes Orders.  In many cases, prior to the Court actually determining the matter and a Judicial Officer making Orders after hearing evidence from both parties, further discussions and negotiations will take place between the parties and their Lawyers and terms of settlement can be reach and Consent Orders can be  made at that time.  Once the Consent Orders are agreed upon by the parties and made by the Court, the Court proceedings come to an end.

When parties are unable to reach an agreement and it is necessary for the Court to determine the matter, the Judicial Officer will make final Orders that will be legally binding upon the parties.  Sometimes urgent issues arise and cannot wait until the determination of the matter on a final basis, and an Interim Hearing takes place and Interim Orders are made.  Those Orders stay in place until Final Orders are made.
