Domestic violence can be broadly defined as a pattern of abusive behaviours by one or both partners in an intimate relationship such as marriage, dating, cohabitation, family or friendship. Domestic violence has many forms, including physical aggression or threats of physical aggression; sexual abuse; emotional abuse; intimidation; stalking; and economic deprivation.

The Australian Institute for Family Studies has found that “66 per cent of separating couples point to partnership violence as a cause of marital breakdown”. Concern about the impact of violence on children is an important factor in the decision to end a relationship. Domestic violence is also an important factor in determining appropriate future parenting arrangements following separation. issues relating to domestic violence need to be carefully identified and considered when parenting Orders are being made either by agreement between parties or in Court proceedings. Domestic violence can also be relevant in some matters involving property.
